The Rockland County District Attorney’s office has received toxicology reports from the fatal Hudson River boat crash on July 26. According to District Attorney Thomas Zugibe, the results will be released when they are presented to a grand jury with a collection of evidence from the accident, where a speedboat driven by Jojo John of Nyack crashed into a Tappan Zee construction barge. The crash killed two of the passengers, 30- year old bride to be, Lindsey Stewart and her fiancé’s best man, 30- year old Mark Lennon. Officers of the Rockland County Sheriff’s Department charged John with one count of second degree vehicular manslaughter and vehicular assault, and according to Sheriff Louis Falco the results of the toxicology report support their investigation and he is confident in an indictment. John’s lawyer, James Mercante, stated that he would not be surprised if the reports came back positive for alcohol impairment, though he stands by earlier remarks that the accident was caused by poor lighting on the barges surrounding the construction site. He stated, “Many people complained about the lighting on the barges and nobody on the boat saw it that night.” State Park Police are currently working on a reconstruction report of the accident, and according to Zugibe, that will help authorities understand the speed of the boat when it impacted with the barge. Based on the decision to be made by the grand jury, John will be seen in Orangetown Justice Court on November 13.
